BAKERSFIELD, CA -- No charges will be filed against Bakersfield City Manager Alan Tandy, after an investigation into an alleged assault at a hockey game.
The Kern County District Attorney's office announced Thursday morning that they finished their investigation over the incident that happened at a local ice rink, and decided there was not enough evidence to file charges.
It happened about two weeks ago, and was caught on security camera. Jonathon Hudson says this video shows Tandy smacking him over the head with a hockey stick after a game.
Hudson has hired a high-profile civil attorney and indicated a lawsuit is in the works. But Tandy's attorney indicated his client was in the right, using his stick to break up a fight in which he saw Hudson near the red arrow in a video grab the face mask of one of Tandy's teammates and violently jerk down twice.
Tandy's attorney says you can tell on security video that the stick did not make contact with Hudson's helmet, but a ref at the game has come forward saying he heard the stick make contact.
City Manager Alan Tandy released the following statement Thursday afternoon:
The District Attorney’s Office did the investigation that was requested of them, and came to the only conclusion possible, based on an objective review of the facts.
I would like to thank Attorney H.A. Sala for effectively presenting the truth to the District Attorney’s Office.
I would also like to thank my family and friends for their support. It has been difficult going through this process, but I believe the facts speak for themselves. It is my hope that this incident can be put in the past, and we as an adult hockey community, can get back to what are the most important aspects of recreational sports – having fun and getting exercise.
I have served the Bakersfield community for nearly twenty two years. The joy and satisfaction I experience from that will continue.
